1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Zine Inc ("Super Simple Host", "we", "us", or "our"), a company registered in Bulgaria at Vl Varnenchik 81, Varna, Bulgaria.

By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.

2. Description of Service

Super Simple Host provides static website hosting services, including but not limited to:

• Cloud storage for static website files
• Content delivery network (CDN) distribution
• Custom domain configuration and SSL certificates
• Git-based deployment and version control integration
• Client APIs
• AI proxy services (OpenAI-compatible)
• Form backend services
• Built-in CMS and member areas (on applicable plans)
• Privacy-friendly analytics
• Client billing and payment features (Agency plan only)

3. Account Registration and Security

To use our services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach
• Not share your account credentials with others

You must be at least 16 years old to create an account. If you are under 18, you must have permission from a parent or legal guardian.

4. Acceptable Use Policy

You agree not to use our services to:

• Violate any applicable laws, regulations, or third-party rights
• Host, distribute, or link to illegal, harmful, or offensive content
• Distribute malware, viruses, or other malicious code
• Engage in phishing, spam, or other fraudulent activities
• Infringe on intellectual property rights of others
• Harass, abuse, or harm other users or individuals
• Attempt to gain unauthorized access to our systems or other accounts
• Interfere with or disrupt our services or servers
• Use automated means to access our services without permission
• Resell or redistribute our services without explicit authorization

We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy.

5. Payment and Billing

5.1 Subscription Plans

We offer multiple subscription tiers (Basic, Pro, and Agency) with different features and pricing. All plans are billed monthly in advance.

5.2 Payment Processing

Payments are processed through Stripe. You authorize us to charge your payment method on a recurring basis until you cancel your subscription.

5.3 Overage Charges

If you exceed your plan's bandwidth allocation, additional bandwidth will be charged at $2 per TB.

5.4 Price Changes

We reserve the right to change our pricing. We will provide at least 30 days' notice before any price increase takes effect for existing customers.

5.5 Refunds

We do not offer refunds for partial months of service. If you cancel your subscription, you will retain access to your account until the end of your current billing period.

6. Cancellation and Termination

6.1 Cancellation by You

You may cancel your subscription at any time. Your subscription will remain active until the end of the current billing period. No refunds will be provided for the remaining period.

6.2 Termination by Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms or our Acceptable Use Policy
• Your payment method fails or your account becomes delinquent
• We are required to do so by law
• We discontinue our services (with 30 days' notice)

6.3 Data After Termination

Upon account termination, your data will be retained for 90 days and then permanently deleted. You are responsible for exporting any data you wish to keep before cancellation.

7. Content and Intellectual Property

7.1 Your Content

You retain all ownership rights to content you upload to our service. By uploading content, you grant us a limited license to store, process, and deliver your content solely for the purpose of providing our services.

7.2 Our Intellectual Property

Our services, including all software, designs, text, graphics, and trademarks, are owned by Zine Inc and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.

7.3 Copyright Infringement

We respond to valid copyright infringement notices in accordance with applicable law. If you believe your copyright has been infringed, please contact us with details of the alleged infringement.

8. Service Level and Uptime

While we strive for maximum uptime, we do not guarantee uninterrupted availability of our services. We are not liable for any downtime, data loss, or service interruptions.

We perform scheduled maintenance and may need to suspend services temporarily for updates, security patches, or infrastructure improvements. We will provide advance notice when possible.

9. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claims arising from or related to our services is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for loss of profits, revenue, data, or business opportunities
• We are not liable for third-party services, links, or content

10. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify and hold harmless Zine Inc and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services, your content, or your violation of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of Bulgaria. Any disputes arising from these Terms or our services shall be resolved in the courts of Varna, Bulgaria.

Before filing a lawsuit, you agree to first contact us to attempt to resolve the dispute informally.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be notified to you via email or through our service at least 30 days before they take effect. Your continued use of our services after changes take effect constitutes acceptance of the modified Terms.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zine Inc
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• Waiver: Our failure to enforce any right or provision does not constitute a waiver
• Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations without restriction
• Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control
